We may also compile or de-identify personal information for analytical purposes, research, and to understand user behavior. When information is de-identified, individual identities are not revealed.

3. How We Disclose Your Personal Information

We may disclose your personal information to third parties in the following situations:

Vendors and Service Providers: We share information with third-party vendors and service providers who perform services on our behalf to support our day-to-day operations (e.g., hosting, payment processing, analytics, customer support, email delivery). These parties are obligated to protect your information and use it only for the purposes for which it was provided.

Business Transfers: In the event of a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your personal information may be transferred to a successor or affiliate.

Affiliated Companies: We may share personal information with companies under common ownership or control with Preppinbee.

With Your Consent: We may disclose your personal information to other third parties with your explicit consent.

3A. Tutor and Student Interactions; Independent Provider Disclaimer

Preppinbee provides a platform that enables Students and Tutors to connect, communicate, and, where applicable, engage in tutoring or related educational services. Tutors are independent third-party providers and are not employees, agents, joint venturers, or representatives of Preppinbee. We do not supervise, manage, or control Tutors, the services they offer, or the interactions between Students and Tutors.

Accordingly, you acknowledge and agree to the following:

a. No Liability for Tutor–Student Interactions

Preppinbee is not responsible or liable for any disputes, interactions, agreements, conduct, or outcomes arising between Tutors and Students, including but not limited to:

  • quality, accuracy, or performance of tutoring or services provided by Tutors
  • cancellations, non-performance, or failure to deliver services
  • communications or conduct between Tutors and Students
  • payment disputes for services offered by Tutors
  • any actions taken by Tutors or Students outside of the Preppinbee platform

All disputes between Tutors and Students must be resolved directly between those parties, and Preppinbee has no obligation to mediate or intervene.

b. No Liability for Data Shared Between Tutors and Students

Tutors and Students may choose to share personal information, uploaded materials, educational records, assignments, files, or other data with one another. Preppinbee does not monitor, verify, or control information exchanged directly between users.

Preppinbee is not responsible for:

  • unauthorized access, misuse, loss, alteration, or disclosure of information shared between Tutors and Students
  • privacy or data-handling practices of Tutors or Students
  • breaches or misuse arising from information exchanged directly between users

Tutors and Students are responsible for evaluating each other’s privacy and security practices before sharing personal information.

c. GDPR Data Controller Clarification

For purposes of the General Data Protection Regulation (GDPR):

  • Preppinbee acts as an independent data controller for personal data it collects and processes to operate the platform.
  • Tutors act as independent data controllers—not joint controllers—regarding any personal data they independently collect from Students or process for tutoring purposes.
  • Preppinbee and Tutors do not jointly determine the purposes or means of such processing; therefore, no joint controllership exists under GDPR Art. 26.
  • Tutors are solely responsible for meeting their own GDPR (or equivalent) obligations, including transparency, data security, and responding to data subject rights relating to data they independently process.

4. Your Privacy Rights and Choices

You have specific legal rights regarding your personal data, particularly if you are in the European Economic Area (EEA), the United Kingdom (UK), Switzerland, or certain U.S. states. We respect your ability to exercise these rights:

Right to Access: You have the right to request a copy of the personal information we hold about you.

Right to Rectification: You have the right to request that we correct any inaccurate or incomplete personal information we hold about you.

Right to Erasure (Right to be Forgotten): You have the right to request the deletion of your personal information under certain circumstances.

Right to Restriction of Processing: You have the right to request that we restrict the processing of your personal information under certain conditions.

Right to Data Portability: You have the right to receive the personal information you have provided to us in a structured, commonly used, and machine-readable format, and to transmit it to another data controller, where technically feasible.

Non-Discrimination for Exercising Rights: Preppinbee will not discriminate against you for exercising any of your privacy rights. This means we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

5. U.S. State-Specific Disclosures

For residents of U.S. states with comprehensive privacy laws, we provide the following additional information:

Categories of Personal Information Collected: In the past 12 months, we have collected the following categories of personal information: Identifiers (e.g., name, email, IP address), Commercial Information (e.g., purchase history, payment information), Internet or Other Similar Network Activity (e.g., Browse history, interaction with our website), and Geolocation Data (derived from IP address). We do not collect categories of sensitive personal information unless voluntarily provided and necessary for service provision as described above.

Purposes for Collection and Use: See Section 2 ("How We Use Your Personal Information") for details on the business and commercial purposes for which we collect and use your personal information.

No Sale of Personal Information: Preppinbee does not sell personal information.

No Sharing for Cross-Context Behavioral Advertising: Preppinbee does not share personal information for cross-context behavioral advertising.

No Processing of Sensitive Personal Data for Inference: We do not process sensitive personal data for the purpose of inferring characteristics about you.

Exercising Your Rights: You can exercise your rights by contacting us at info@preppinbee.com. We may require you to provide information to verify your identity before processing your request.

Authorized Agents: If you use an authorized agent to submit a request on your behalf, we may require proof of the agent's authorization and verification of your identity.

6. Children's Privacy

Our Services are not intended for children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to remove that information from our servers.

For children between 13 and 17 years of age, parental or guardian permission may be required to use certain aspects of our Services or provide personal information.

Our Services may contain links to websites or services operated by third parties. We are not responsible for the privacy practices or the content of these third-party sites. We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, including for the purpose of satisfying any legal, accounting, or reporting requirements. When we no longer have a legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Preppinbee operates globally. Your personal information may be stored and processed in the United States or any other country where Preppinbee or its service providers maintain facilities. By using our Services, you understand that your information may be transferred to countries outside of your country of residence, which may have data protection laws different from those in your country.

For users in the EEA, UK, or Switzerland, we ensure that any transfer of personal data outside of these regions is done with appropriate safeguards, such as standard contractual clauses approved by the European Commission, to ensure a similar level of protection to that afforded in the EEA/UK/Switzerland.

11. Automated Decision-Making and Profiling

We do not use automated decision-making processes (i.e., decisions made solely by automated means without human involvement) that produce legal effects concerning you or similarly significantly affect you. While we may use aggregated or de-identified data for analytics and to understand user behavior (as mentioned in Section 2), this is not used for automated individual decision-making that would have a significant impact on your rights or access to services.

14. Data Shared Voluntarily Between Users

Students and Tutors may choose to share personal information, educational content, messages, files, assignments, schedules, or other data with one another within or outside of the platform. You understand and agree to the following:

a. Voluntary Sharing

Any information you choose to share directly with another user is provided voluntarily and at your own discretion. Preppinbee does not require users to exchange personal or sensitive information outside what is needed for platform functionality.

b. Independent Data Controllers

Tutors and Students who collect, receive, or store personal information from one another act as independent data controllers for that information. Each party is solely responsible for:

  1. determining the purposes and methods of processing
  2. securing the information they obtain
  3. complying with applicable privacy laws and obligations
  4. responding to rights requests related to the data they independently process

Preppinbee is not responsible for compliance failures of Tutors or Students.

c. No Monitoring or Verification

Preppinbee does not monitor, inspect, filter, or verify communications, files, or personal data exchanged directly between Tutors and Students. We are also not responsible for:

  1. accuracy of information shared
  2. legality of content exchanged
  3. user conduct during or after interactions

d. No Liability for User-Generated Data Exchanges

Preppinbee is not liable for any harm, loss, or breach resulting from information users share with one another, including:

  1. unauthorized access
  2. misuse or disclosure by the receiving party
  3. data breaches originating from a Tutor or Student
  4. reputational, academic, financial, or personal harm resulting from shared information

Users should exercise caution and good judgment when deciding what to share.

15. No Agency or Employment Relationship

Nothing in these Services creates any partnership, joint venture, employment, or agency relationship between Preppinbee and Tutors. Tutors are not authorized to make commitments or representations on behalf of Preppinbee.
